These Terms of Service ("Terms") are a legal agreement between you and EmergeMD LLC ("Boardright," "we," "us," or "our"), an Arizona limited liability company, governing your use of the Boardright mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. The Service is designed for anesthesiology residents, fellows, physicians, and others preparing for the ABA APPLIED (oral) examination. By using the Service, you represent that you meet these requirements.
2. What Boardright is
Boardright is an educational study aid that uses artificial intelligence to simulate oral board–style clinical scenarios, ask follow-up questions, and provide scored feedback and rapid-fire practice questions. It is a preparation tool only.
3. Medical and educational disclaimer
Boardright does not provide medical advice. All content is for educational and exam-preparation purposes only and must not be used to diagnose, treat, or manage any actual patient. Always rely on your own clinical judgment, supervising physicians, and current authoritative sources for patient care.
AI-generated content may be inaccurate, incomplete, or out of date. You are responsible for independently verifying any clinical information. Boardright does not guarantee that using the Service will result in passing any examination.
No affiliation. Boardright is an independent product and is not affiliated with, sponsored by, or endorsed by the American Board of Anesthesiology (ABA). "APPLIED" and other exam names are used descriptively to identify the examinations for which the Service helps you prepare.
4. Appropriate use of content
You agree not to enter real patient-identifiable information, protected health information (PHI), or other confidential clinical data into the Service. The Service uses fictional scenarios and is not intended to receive or store real patient data.
5. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@boardright.app if you suspect unauthorized use. Accounts are for individual use and may not be shared.
6. Subscriptions, billing, and free trial
- Boardright is offered as an auto-renewing annual subscription priced at $199.99 per year (or the equivalent in your local currency), which may include a free trial period.
- Payment is charged to your Apple App Store or Google Play account at confirmation of purchase, or at the end of any free trial.
- The subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your Apple App Store or Google Play account settings. Deleting the app does not cancel your subscription.
- If you start a free trial and do not cancel before it ends, you will be charged for the subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.
- Except where required by law or by the applicable app store's policies, payments are non-refundable. Refund requests are handled by Apple or Google under their policies.
- Prices and features may change; we will provide notice of material changes as required, and price changes will not affect your current paid period.
7. Acceptable use
You agree not to: (a) copy, scrape, resell, or redistribute the Service or its content; (b) reverse engineer, decompile, or attempt to extract source code or underlying models; (c) use the Service to build a competing product; (d) interfere with or disrupt the Service or its security; (e) use automated means to access the Service except as expressly permitted; or (f) use the Service in any unlawful manner.
8. Intellectual property
The Service, including its software, design, text, scenarios, and branding (including the Boardright name and logo), is owned by EmergeMD LLC and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal exam preparation.
9. Your content
You retain ownership of the answers and responses you submit ("User Content"). You grant Boardright a worldwide, non-exclusive license to process and use your User Content as needed to operate and improve the Service (including transmitting it to our AI provider to generate responses and scoring), consistent with our Privacy Policy.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOARDRIGHT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOARDRIGHT AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless EmergeMD LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or other users. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
14. Apple App Store terms
If you download the app from the Apple App Store, you acknowledge that: these Terms are between you and Boardright, not Apple; Apple has no obligation to provide maintenance or support for the app; Apple is not responsible for any product warranties or claims relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Your use of the app must also comply with the Apple Media Services Terms and the standard Apple end-user license agreement (EULA).
15. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us at support@boardright.app and attempt to resolve the dispute informally. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona, unless otherwise required by applicable law.
16. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
